Terms of Service

Please read carefully.

These Terms include a binding arbitration agreement and a class-action waiver (Section 13) that affect how disputes between you and Ascend are resolved. Ascend provides general career guidance only — it is not professional legal, financial, medical, mental-health, or employment advice.

1. Acceptance

By creating an account or using Ascend, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Your account

You are responsible for keeping your credentials secure and for activity on your account. You must be at least 16 years old (or the age of digital consent in your country) to use Ascend.

3. Acceptable use

  • No illegal, harmful, harassing, or abusive content.
  • No scraping, reverse engineering, or attacks on our infrastructure.
  • No impersonation or attempts to access another user's account.
  • No use of the AI features to generate disallowed content (e.g. malware, targeted harassment, sexual content involving minors).

4. Content you create

You own the content you submit. You grant us a limited, worldwide, royalty-free license to store, process, and display it solely to operate the service for you.

5. Subscriptions, billing, and refunds

  • Paid plans renew automatically until cancelled. Prices are shown at checkout.
  • Web (Stripe): manage or cancel any time from Settings → Billing. Cancellations take effect at the end of the current billing period.
  • iOS (Apple in-app purchase): manage or cancel via your Apple ID → Subscriptions. Apple's refund policy applies.
  • EU/UK consumers — 14-day withdrawal: by purchasing a digital subscription and starting to use it, you expressly request immediate performance and acknowledge that you lose your statutory 14-day right of withdrawal once the service has been fully performed.
  • 2-day money-back guarantee: if you are not satisfied for any reason, contact support@ascends.live within 2 days of purchase for a full refund. Refunds beyond this window are at our discretion.

6. AI-generated guidance

Ascend uses AI models to generate suggestions and coaching. Outputs are guidance only and are not professional, legal, financial, medical, or psychological advice. You are responsible for decisions you make based on them.

Ascend uses AI models to generate suggestions, career maps, salary estimates, resume edits, interview prep, and coaching responses. Outputs may be inaccurate, incomplete, or out of date and are provided for informational and educational purposes only. They are not professional legal, financial, tax, investment, medical, mental-health, psychological, employment, immigration, or recruiting advice, and do not create any advisor-client relationship. Always verify important information and consult a qualified licensed professional before acting on it. You are solely responsible for decisions you make, including job, financial, educational, and relocation decisions.

7. User-generated content & community

Community posts, comments, salary submissions, and accountability groups are user-generated. We do not endorse user content and are not responsible for it. You may report content that violates our rules; we may remove content and suspend accounts at our discretion. Do not post confidential employer information, personal data of others, or anything you do not have the right to share.

8. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Ascend, its affiliates, officers, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) content you submit; (c) your violation of these Terms or applicable law; or (d) your infringement of any third-party right.

9. Termination

You can delete your account anytime in Settings → Danger zone. We may suspend or terminate accounts that violate these Terms or applicable law. Sections that by their nature should survive (IP, disclaimers, limitations of liability, indemnification, dispute resolution) will survive termination.

10. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation, to the maximum extent permitted by law. We do not warrant any specific career, salary, educational, or employment outcome. Nothing in these Terms limits any rights you have as a consumer that cannot be waived under applicable law (including the EU Consumer Rights Directive and UK Consumer Rights Act).

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or career or employment opportunities. Our total aggregate liability arising out of or relating to the service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the claim or (b) USD $100. This does not limit liability that cannot be excluded by law (e.g. death, personal injury caused by negligence, or fraud).

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Consumers in the EEA and UK retain the protection of mandatory laws of their country of residence and may bring claims in their local courts. EU consumers can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Binding arbitration & class-action waiver (US users)

Please read this section carefully — it affects your legal rights. If you reside in the United States, you and Ascend agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the service through final, binding, individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in English, seated in Wilmington, Delaware (or remotely, at your option). The arbitrator, not any court, has exclusive authority to resolve disputes about the formation, scope, or enforceability of this arbitration agreement.

Class-action waiver: You and Ascend agree to bring claims only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding.

Small-claims carve-out: Either party may bring an individual claim in small-claims court for disputes within that court's jurisdiction.

30-day opt-out: You may opt out of this arbitration agreement by emailing legal@ascends.live within 30 days of first accepting these Terms with the subject "Arbitration opt-out" and your account email. If you opt out, Section 12 (Governing law) and the Delaware courts will govern disputes; the rest of these Terms still apply.

14. DMCA & copyright

If you believe content on Ascend infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c) to our designated agent at dmca@ascends.live. We will respond to valid notices and may terminate repeat infringers.

15. Apple App Store — additional terms (iOS)

If you obtained Ascend through the Apple App Store, the following also apply: (a) these Terms are between you and Ascend only, not Apple, and Apple is not responsible for the app or its content; (b) the license is a non-transferable license to use the app on Apple-branded devices you own or control, consistent with Apple's Media Services Terms; (c) Apple has no obligation to provide maintenance or support; (d) Apple is not responsible for any product warranties, product or intellectual-property claims, or refunds (Apple's standard policy applies to in-app purchases); (e) you represent you are not in a country subject to a US-government embargo and are not on any US-government prohibited-parties list; and (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes

We may update these Terms; we will notify you of material changes. Continued use means you accept the changes.
